  AGREEMENT AND WARRANTY'S INFORMATION

BUYER HAS HAD A CHANCE TO VIEW AN ADVANCED COPY OF THIS GUARANTEE ONLINE BEFORE DECIDING TO PURCHASE A PUPPY AND BUYER AGREES TO THESE TERMS AND GUARANTEES SIMPLY BY THE ACT OF ACCEPTING THE PUPPY, EVEN IF CONTRACT IS NOT SIGNED BY BUYER.
  1. For a better understanding this contract is written in plain English. (WE) represents the seller and (YOU) represents the buyer.
  2. This contract takes effect immediately after your payment is received, this is an online contract and no signature is required.
  3. It is understood that all shipped puppies will include an Interstate Health Certificate and will be certified healthy (or fit for sale) at the time of sale or delivery.
  4. Within 4 days of arrival/pickup date (allowing an extra day for holidays); you must take your puppy to your preferred vet to verify the health of your puppy or the warranty becomes null and void. If a serious condition is found, you must report any problems immediately before taking any actions.

    GENETIC DISORDERS AND COMMUNICABLE DISEASES WARRANTY.
  5. All puppies come with only current vaccinations (That means they will need additional shots before they can be considered fully immune to a disease). However we will provide and honor the following coverage. You will receive either an exchange of your puppy or a store credit for the full purchase price if…
  6. Your dog is found with a life threatening genetic or hereditary condition within a period of 12 months from the pickup or delivery date.
  7. The dog is found with canine parvovirus within 10 days from the pick up or delivery date.
  8. The dog is found with canine distemper within 15 days from the pick up or delivery date.
    ---------NOTE---------
  9. Store credit will be based on the full purcahse price only (What you paid for your puppy itself) and shipping costs are not included. The same concept applies if an exchange is needed; the buyer must pay for both ways delivery costs (from and to seller).
  10. Keep in mind that this warranty does not pay for vet bills or reimbursements. There are some hereditary issues not considered life threatening or deadly (like hip dysplasia, luxating patella, etc). Most pet health insurance will cover these situations. It is your responsibility and obligation to buy a pet health insurance. -----------------------------------------------------------------------------------
    GUARANTEE LIMITATIONS AND RESTRICTIONS:
  11. Under no circumstances this warranty will cover or pay for vet bill reimbursements, money back or cash back.
  12. Once your puppy has been vet checked, health certified and therefore released, you are fully responsible for any and all extra expenses related but not limited to treatments, hospitalizations, accessories, euthanasia fees, cremation fees, disposal fees etc.
  13. Before store credit or exchange is given, a death or disease report issued by a licensed veterinarian is required (NOT THE BILL).
  14. The seller will not accept any returns of the pet, including but not limited to allergies, Landlord/Tenant, marital, adjustment problems, etc.
    ---------    PARASITES---------
  15. Before shipped, all puppies went to a routine of dewormings for giardia (treated with metronidazole for 5 days), coccidias (Treated with Albon for 7 days) and worms (Treated with panacure or albendazole for 3 days) on top of that, our puppies will be parasite or fecal tested before delivered or released. In a case where your puppy is found with a parasite at our checkup, we will apply additional dewormings and/or may send your dog with a dewormer for follow ups.
    After your puppy is received, it is your responsibility to apply additional fecal testing, dewormings and treatments (if needed).
    ---------SKIN CONDITIONS---------
  16. We comply with a preventative dipping of Lime sulfur (LymDyp). This is to prevent from external parasites like Sarcoptic Mange (Scabies) and Ringworms (Fungus). If your puppy is detected with any of these 2 conditions, we will gladly send you the medication (LymDyp) but we will not reimburse you for any related vet bills.
  17. The seller disclaims any and all implied warranties of merchantability and fitness and under no circumstances the seller can guarantee expected size, personality, temperament, color, ear set, breeding ability, house breaking ability, coat type, tail size (clipped/unclipped), show ability or generations.
  18. This warranty does not include hernias (known or unknown), small heart murmurs, colds, over bites, under bites, ear mites (if detected we will treat it), kennel cough, hypoglycemia, diarrhea, parasites (Internal and externals) and coccidias (worms and coccidias are 100% preventable and treatable we include a fecal examination before shipping the dog) or any non-life threatening problems like hip dysphasia, luxating patella (which can be cause by negligence or inappropriate care) or other conditions that may require surgery; once again; it is responsibility of the buyer to purchase a pet health insurance to cover these situations or return the dog for an exchange.
  19. The warranty will NOT cover neglect, abuse, lost or stolen pets. This warranty is non-transferable.
  20. Our puppies are sold as (pets) only and no registration papers will be offered or included unless advertised on each listing.
  21. The value of the pet for the purpose of this guarantee is solely the original purchase price, and does not include any additional prices declared by the buyer.
  22. All lemon laws from other states are null and void; this warranty fulfils and complies in full with the laws in the state of Texas where CSPUPPIES is located.
  23. Do not buy a puppy online if you are picky about shipping dates, pickup times. We reserve the right to delay or reschedule the flight due to emergencies beyond our control or puppies not being ready to fly.
  24. Seller guarantees that the buyer will receive the exact puppy discussed via email, in pictures, and over phone with the buyer. (However there may be a slight or significant difference in color from picture to puppy. (flash light, room light, days to weeks after picture, etc)
  25. The warranty if voided if your puppy/dog has been bred.
  26. Do not expect anything else that is not written on this contract. Venue and jurisdiction for litigation arising out of or related to CSpuppies shall lie exclusively in Hidalgo County, Texas.
    ---------SIZE---------
  27. We try to be as honest as possible about sizes, but we are not always perfect!
    Sometimes a pup will turn out a smaller or larger than we expect. We set their sizes relying on the information we obtain from the breeder, this information is based size of the parents and it may or may not be accurate for that reason we cannot     guarantee sizes. However we will comply with a 25% partial refund (over the puppy’s value) if such dog has grown twice of his expected adult size. If you are very picky about sizes please do not buy from us, we want owners with unconditional love to their dogs.
    ---------DELIVERY POLICY---------
  28. You agree to pre-pay all delivery costs at your own expense; these fees include the flight or ticket, a health certificate, and the travel crate or kennel. You are 100% responsible for any transportation costs to and from the Seller. We do not work for the airlines and we only collect your money to pay the airlines on your behalf. Only our puppies come with a guarantee.
  29. We make the bookings within 24 hours and our main communication is made by email. We will email your booking or confirmation number within 72 hours. You have to check or monitor your emails and in a case you have not received the flight information you must call us immediately since sometimes emails fail.
  30. Once we have dropped off your puppy at the airlines, you are fully responsible to pick up your puppy at the airport; neither CSpuppies nor the airlines would accept liabilities if your puppy is abandoned at the airport. You are subject to any kenneling fees implied by the airlines. If you do not show up to pick up the dog, you are responsible to pay for any returning fees of the dog.
    -----------LIABILITIES-------------------
  31. We will dispute all chargebacks and will send any unpaid balance to collections where additional fees will apply.
  32. Any collateral financial distress created by the buyer will also placed for collections.
    ---------DISCLAIMER---------
  33. Some vets may have decent prices but others may be very expensive and we can not control that, it all depends on where the buyer lives (or your local economy level). The buyer can always rely on returning the dog, euthanasia option, surrender to the humane society or sign over to a shelter/vet clinic. Only the buyer can make those decisions and we take no responsibilities for actions or financial decisions made by the buyer. All buyers must rely 100% on their veterinarian professionalism and honesty. Honest Vets will not charge a fortune for a diagnosis. Most can rely on physical symptoms to determine if it has a deadly illness and decide if euthanasia or treatment should be applied.
  34. From time to time we apply changes to our guarantee policies; these new changes will not affect previous purchases.

    CANCELLATION FEES, SWITCHING FEES AND DEPOSIT POLICIES:
  35. We will apply or deduct a $200.00 cancellation fee and will give you a credit of $50 (held as store credit). This credit will remain available for the next 12 Months.  Cancellation fees are waived if CSPUPPIES cancels the order due to illness or if such puppy becomes unavailable for sale or if such puppy can not be shipped within the next 30 days. This cancellation fee policy takes effect immediately after the purchase even if the buyer has not submitted the warranty.
  36. There is a $150 switching fee (switching affects drastically our tight schedule since we post many classifieds for advertising). Switching fee is waived if the original puppy becomes ill and unable to ship within the next 15 days.
  37. Deposits are non-refundable and will be held as store credit for a period of 6 months.
  38. Once the puppy is ready to be released, the buyer must pay the remaining balance (or at least arrange a payment plan) within 5 -10 days or the seller reserves the right to resell the puppy.

    EUTHANASIA:
  39. Within the warranty period, the buyer may authorize his/her vet to euthanize your puppy if it was found with a life threatening/deadly communicable disease (Parvo and distemper) or a deadly congenital disorder. Euthanasia is NOT accepted under any other circumstances.
