Instructions for Application:
The Shelby County District Attorney’s Justice Review Unit (“JRU”) will review only felony convictions and/or sentences that occurred in state court in Shelby County. The minimum requirements are set out below.
- Must have been a felony conviction;
- Must have been a conviction in Shelby County; or
- Must have been prosecuted by members of the Office of the District Attorney General for Shelby County;
- Must have a claim of actual innocence, unjust procedure and/ or unjust sentence.
The Applicant must be seeking review of a conviction the Applicant believes was a wrongful conviction because of a claim of actual innocence, just procedure and/ or unfair sentence. In certain situations, the JRU will consider cases pending on active appeal or active post-conviction petition. If the convicted person is represented by an attorney, we will communicate only with that attorney.
No convictions from the Federal District Court at Memphis will be accepted. All communications with the JRU must be in writing. Once you have submitted your application, please do not call the DA’s office or the JRU for updates on your Application. The process can take a long time. When the JRU receives your Application, you or your attorney will receive written notice from the JRU. There will be follow up written notifications as needed.
THERE IS NO GUARANTEE THE CONVICTION REVIEW UNIT WILL ACCEPT YOUR REQUEST FOR REVIEW OR FURTHER INVESTIGATE YOUR CONVICTION.
RECEIPT OF YOUR APPLICATION IN NO WAY TOLLS OR EXTENDS THE TIME YOU HAVE TO PURSUE POST-CONVICTION REMEDIES SUCH AS FILING AN APPEAL OR POSTCONVICTION MOTIONS.
