You consent to receive communications from us electronically. We will communicate with you by e-mail or phone. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
As a member, guest, participant of New York City Team Handball Club and for using the
associated practices and playing facilities and equipment at Park West High School and John
Ericsson 126 School, and in consideration of the voluntary nature of such participation and use, I
hereby release, hold harmless, and forever discharge New York City Team Handball Club, Inc.
and Park West High School, John Ericsson 126 School, DOE and New York City, its board of
directors, officers, members, employees, agents from any and all liability, claims, demands,
actions, and causes of actions whatsoever arising out or related to any loss, property damage, or
personal injury, including death, that may be sustained by me or to any property belonging to me,
whether caused by the negligence of the New York City Team Handball Club, Inc. and Park West
High School, John Ericsson 126 School, DOE and New York City, its board of directors, officers,
members, employees, agents, or otherwise, while participating in such activity. Such participation
includes practice, club functions, competition, and travel to and from all club activities.
I am fully aware of the risks and hazards associated with participation during practices and use of
the facilities and equipment. I hereby elect voluntarily to participate in said activities and fully
acknowledge that the full responsibility for any risk or loss, property damage, or any loss or any
personal injury, including death, that may be sustained by me or any loss or damage to property
owned by me as a result of being engaged in such activities, whether caused by negligence of the
New York City Team Handball Club, Inc. and Park West High School, John Ericsson 126 School,
DOE and New York City its employees or agents, or otherwise. I further acknowledge that I have
procured on my own adequate insurance for such loss, damage, and injury. I further agree to
indemnify and hold harmless the New York City Team Handball Club, Inc. and Park West High
School, John Ericsson 126 School, DOE and New York City its board of directors, officers,
members, employees, agents from any loss, liability, damage or cost, including court costs and
attorney's fees that may incur due to my participation in said activities, whether caused by the
negligence of the New York City Team Handball Club, Inc. and Park West High School, John
Ericsson 126 School, DOE and New York City, its board of directors, officers, members,
employees, agents, or otherwise.
This release and hold harmless agreement is binding on myself, my heirs, assigns, and personal
representatives.
WAIVER & PHOTO RELEASE LIABILITY
In consideration of being allowed to participate in any way in New York City Team Handball Club programs,
related events and activities including games, scrimmages, tournaments, etc., the undersigned
acknowledges, appreciates and willingly agrees that:
1. I will comply with the stated and customary terms and conditions for participation. If I observe any unusual
significant hazard during my presence or participation, I will remove myself from participation and bring such
to the attention of the nearest official immediately; and,
2. I acknowledge and fully understand that each participant will be engaging in activities that involve risk of
serious injury, including permanent disability and death, and severe social and economic losses which may
result not only from their own actions, inactions or negligence but the action, inaction or negligence of others,
the rules of play or the condition of the premises or of any equipment used. Further, I accept personal responsibility
for the damages following such injury, permanent disability or negligent acts or omissions of others,
and assume full responsibility for my participation; and
4. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, hereby release,
hold harmless, New York City Team Handball Club, its officers, officials, coaches, team leaders, affiliated
clubs, their advertisers, and, if applicable, owners and lessors of premises used to conduct the event, all of
which are hereinafter referred to as “releasees,” with respect to all any injury, disability, death, or loss or damage
to person or property, whether arising from the negligence of the releasees or otherwise, to the fullest
extent permitted by law.
5. I do hereby give New York City Team Handball Club, its assigns, licensees, and legal representatives the
irrevocable right to use my name, picture, portrait, ro photograph in all forms and media and in all manners,
including composite, for advertising, for publication or any other lawful purposes, and I waive any right to inspect
or approve the finished product, including written copy, which may be created in connection therewith.
I HAVE READ THIS RELEASE OF LIABILITYAND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND
ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT
AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
